The case of a 14 year old Clearfield County Boy accused in the deadly shooting of a 12 year old Girl has been moved to Juvenile Court.
According to a recent court order Clearfield County President Judge Fredric Ammerman approved the defense’s motion filed in November.
The boy was initially charged as an adult for the killing of Ashlyn Niver at his home in Brady Township in late April of last year.
Court documents show the boy was evaluated by an expert psychologist who stated he would be able to receive the proper care within the Juvenile Court System.
District Attorney Ryan Sayers says his office is appealing the ruling.
“The Commonwealth disagrees with the Judge’s decision to transfer this case to Juvenile Court. This decision is not in the public’s interest and it does not promote justice in this case for the victim and the victim’s family.”
Sayers says an appeal to the Superior Court has been filed by his office looking to overturn the decision.
