In a Centre County town, one man’s legal battle against the town council will stretch into next year.
After months of controversy, Milesburg resident J. Bryce Taylor filed a civil suit against the borough, claiming violations of the Sunshine Law, and other borough council proceedings, including how vacanicies were being filled on council.
Taylor claimed he asked the Attorney Generals Office, and Centre County District Attorneys Office to look into the allegations, before eventually filing the suit, this past Summer.
Taylor won an early victory in court, with a judge dismissing the borough’s preliminary objections. But in a follow up filing from the borough, there’s a more detailed defense of the council actions, and in whats termed a new matter
The borough claims Taylor lacks standing to challenge the council appointments, and adds the Sunshine Act alone does not provide legal basis to challenge the appointment of council members.
The borough is asking for the lawsuit to be dismissed. A judge has scheduled a status conference on the case early next week
