A federal lawsuit stemming from allegations a Centre County contractor illegally diverted employee pension money Is still ongoing with the presiding judge issuing a new order this week on evidence issues.
After Glenn O. Hawbaker Incorporated pleaded no contest to four counts of theft ,filed by the State Attorney General,and paid more than twenty million dollars in restitution in 2021, a group of former employees filed suit in Federal Court, now there’s questions whether a 2015 Federal Department of Labor Investigation into Hawbaker will play a role in the ex employees suit.
The former workers contend Hawbaker failed to make the required amount of contributions in to company retirement and benefit programs. Hawbaker has denied any wrongdoing.
Those who filed suit in the Federal case contend Hawbaker is withholding documents from a 2015 Labor Department investigation, along with other information, including a 2021 Federal subpoena.
The Presiding Judge, issuing an order this week, asking for responses from both sides by August 2nd.
The federal case, is a class action suit that could include more than 14 hundred current and hourly Hawbaker employees who worked prevailing wage jobs in Pennsylvania during a six year period.
