A Penn State trustee who is facing possible removal from the trustee board says the latest action against him is all due to an alleged joke he told from a well-known movie in front of other trustees.
Now, he’s asking a Centre County judge to issue an injunction, blocking him from being removed from the board until the issue is resolved.
Barry Fenchak’s tenure on the Penn State Board of Trustees is becoming well documented.
In the latest chapter, he filed an emergency motion in Centre County court on Monday for a preliminary injunction to block his removal from the trustee board, at least for now.
Earlier this month, the trustees’ governance committee voted to expel Fenchak from the trustees for an alleged violation of the trustee code of conduct.
That decision came after Fenchak filed another suit against trustee leadership in July, saying he’s being blocked from requesting university related financial information.
So, what sparked the latest action, the move to kick him off the trustee board?
According to Fenchak, it’s due to a comment he made on July 9th after a trustee meeting at the Altoona campus.
Fenchak says he merely repeated a line from the movie, “A League of their Own,” that contained a word some may find objectionable.
Fenchak says in response to the comment, an investigation was done that resulted in the committee recommendation to remove him from the board.
Fenchak claims that recommendation is tied to his previous requests for information and his lawsuit.
Fenchak says he filed the motion for injunction, hoping to get a court ruling, to block that vote, until litigation is resolved.
