A new development in the court battle between Penn State and the State College Spikes, as a Centre County Judge has approved mediation for both sides.
The new order issued Thursday by Centre County Judge Brian Marshall says Penn State and the Spikes have agreed to a joint stipulation to stay litigation until mediation which is scheduled for June 16th.
The court ordered stay includes any proceedings, petitions and pleadings in the case. The new order also stipulates a new judge will be overseeing the case, after Judge Marshall voluntarily disclosed his wife is a long time Penn State Employee.
Penn State claims the Spikes failed to renew a new lease to use Medlar Field at Lubrano Park, and that the University has been forced to subsidize the team.
The Spikes have termed the lawsuit as meritless.
